EM1 Technologies, Inc. (“EM1,” “we,” “us,” or “our”) provides an AI-powered software-as-a-service platform purpose-built for public safety agencies and related organizations. This Privacy Policy explains how we collect, use, disclose, and protect personal information through our website at em1.com and any related marketing pages, web forms, and online resources (collectively, the “Website”), as well as in connection with our business relationships with prospective customers, customers, partners, and job applicants in the United States.
This Policy applies to personal information we collect from website visitors, prospective customers, customer personnel, marketing contacts, business partners, job applicants, and other individuals who interact with us through the Website or in the ordinary course of our business. It does not govern personal information that our customers process within the EM1 platform where EM1 acts as a service provider, processor, or contractor on behalf of the customer; that information is handled in accordance with the SaaS Customer Agreement (or other written agreement) between EM1 and the applicable customer. We have included a short summary at the end of this Policy describing how platform data is handled at a high level.
If you do not agree with this Policy, please do not use the Website or submit personal information to us.
1. Scope, Role, and Definitions
“Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identifiable individual. It does not include aggregated, de-identified, or anonymized information.
“Website” refers to EM1’s public-facing websites, marketing pages, and online forms. It does not include the authenticated EM1 platform, where EM1 generally processes personal information on behalf of customers pursuant to separate customer agreements.
For personal information covered by this Policy, EM1 generally acts as the business or controller for its own business purposes. For personal information processed in customer content submitted to the EM1 platform, EM1 generally acts as a service provider, processor, or contractor to the applicable customer and processes that information under the customer's instructions and the applicable contract.

2.1 Information You Provide to Us
We collect personal information you choose to provide when you interact with us, including when you:
Submit a contact, demo request, or inquiry form on the Website
Subscribe to our newsletter, blog, or marketing communications
Register for a webinar, event, or download a resource (such as a white paper or case study)
Apply for a position with EM1
Communicate with us by email, phone, or other means
The information we collect in these contexts typically includes your name, business email address, phone number, job title, employer or agency name, and the contents of any message you send us. For job applicants, this may also include your resume, employment history, and any other information you choose to share.
2.2 Information Collected Automatically
When you visit the Website, we and our service providers automatically collect certain technical information using cookies, log files, and similar technologies. This includes:

We do not sell personal information or share personal information for cross-context behavioral advertising. We share personal information only as described below:
Service providers, contractors, and subprocessors. We share personal information with vendors who perform services on our behalf, such as cloud hosting, website analytics, email and marketing platforms, customer relationship management, contract management, and security tools. These providers are bound by contractual obligations to protect personal information and to use it only for the purposes we authorize.
Business partners. We may share information with consulting partners, resellers, or co-marketing partners who help us deliver services to emergency management organizations, in accordance with applicable agreements.
Legal and safety. We may disclose information when we believe disclosure is necessary to comply with applicable law, valid legal process (such as a subpoena or court order), respond to lawful requests from public authorities, enforce our agreements, or protect the rights, property, or safety of EM1, our users, or others.
Business transfers. If EM1 is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its business or assets, personal information may be transferred to the successor or acquiring entity, subject to this Policy or a successor policy.
With your consent. We may share personal information for other purposes with your consent or at your direction.
7. Data Security and Integrity
EM1 maintains commercially reasonable administrative, physical, and technical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. These safeguards include access controls, encryption in transit, monitoring, vendor risk management, and personnel training. EM1’s information security program is designed to align with the AICPA SOC 2 Trust Services Criteria.
No method of transmission over the internet or method of electronic storage is fully secure. While we work to protect personal information, we cannot guarantee absolute security. If we become aware of a security incident that materially impacts the confidentiality, integrity, or availability of personal information we hold, we will notify affected individuals and customers as required by applicable law and our contractual commitments.
8. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the context in which it was collected. When personal information is no longer needed, we delete or de-identify it in accordance with our internal retention schedules.
9. Your Privacy Rights and Choices
Depending on your U.S. state of residence and subject to certain exceptions, you may have the following rights regarding your personal information:
The right to access personal information we hold about you
The right to request correction of inaccurate or incomplete information
The right to request deletion of your personal information
The right to opt out of certain processing for targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects, to the extent applicable

We may need to verify your identity before fulfilling certain requests, and where permitted by law we may deny a request in whole or in part. If we deny your request, we will explain how you may appeal the decision, if an appeal right is available to you.
You may also unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any marketing message we send or by contacting us. Note that you may still receive transactional or service-related communications from us.
10. Supplemental U.S. State Privacy Disclosures
Some U.S. states (including California, Colorado, Connecticut, Virginia, and Utah, among others) provide their residents with specific privacy rights. To the extent these laws apply to our processing of your personal information, you may have the rights described in Section 9 above. We do not sell personal information, do not share personal information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act, and do not use or disclose sensitive personal information for purposes other than those permitted by applicable law. We also do not profile individuals in furtherance of decisions that produce legal or similarly significant effects in connection with the Website.
If you are a California resident, you may also designate an authorized agent to make a request on your behalf. We will require verification that the agent is authorized to act for you.
In the preceding 12 months, we have collected the categories of personal information described in Section 2, used those categories for the purposes described in Section 3, and disclosed those categories to the categories of recipients described in Section 6. We retain each category of personal information for as long as reasonably necessary for the purposes described in Section 8, unless a longer retention period is required or permitted by law.
11. U.S.-Only Operations
EM1 operates in the United States and provides its Website and services for U.S.-based business activities. Personal information covered by this Policy is processed and stored in the United States by EM1 and its service providers. This Policy is not intended to address privacy rights arising under non-U.S. laws except to the extent such laws cannot be disclaimed as a matter of law.
12. Children’s Privacy
The Website is intended for business users and is not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child under 16, please contact us and we will take appropriate steps to delete it.
13. Third-Party Websites and Services
The Website may contain links to third-party websites or services that are not operated by EM1. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party websites or services you visit.
14. Customer Platform Data
This Policy addresses personal information collected through the Website and in connection with EM1’s own business operations. EM1’s customers (typically emergency management agencies, utilities, airports, hospitals, public safety organizations, and similar entities) submit content and inputs into the EM1 platform. EM1 processes that data as a service provider, processor, or contractor on behalf of those customers, in accordance with the applicable customer agreement. EM1 does not use or disclose customer platform data except as permitted by the applicable customer agreement or as otherwise permitted by law. If you are an end user of the EM1 platform and have questions about how your information is handled, please contact your organization’s administrator or the EM1 customer of record.
15. Changes to This Policy
EM1 reviews this Privacy Policy at least annually and updates it as needed to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the “Last Updated” date at the top of this Policy and, where appropriate, provide additional notice (for example, by posting a notice on the Website or sending an email to registered contacts). We encourage you to review this Policy periodically.
